1. Our Role and Technical Functionality

It is crucial to understand the functional nature of Freshsave.net. We are a non-hosting, non-storage utility.

We Do Not Host Content:
Freshsave.net does not host, store, or upload any copyrighted files, video content, or streaming media. Our website is strictly a technical intermediary tool that allows users to generate a download link for content that is already publicly available and hosted by Instagram (or its related content delivery networks).

We Are a Conduit:
We function as a search engine or directory for publicly available links. When a user inputs a URL, our system merely parses that external URL and extracts the highest-quality download path that the Instagram platform makes available.

No Control Over Source:
We have no control over the content hosted on Instagram’s servers. Our service is designed solely to facilitate the user’s personal, private, and offline archiving of public content.

Despite our role as a technical conduit, we take intellectual property rights seriously and will take decisive action upon receiving a legally valid takedown notice. Because we do not store the infringing content, the action we take is to disable the specific link processing function for the identified content, thereby preventing future downloads via our tool.

2. Procedure for Submitting a Takedown Notification (The “Notice”)

A valid takedown notice must be submitted by the copyright owner or an agent authorized to act on behalf of the owner, and it must substantially comply with the requirements set forth in 17 U.S.C. § 512(c)(3). Notices that do not include all the necessary information outlined below will not be processed.

Required Elements of a Valid Takedown Notice:

To ensure prompt and effective processing, your notification must include all of the following elements:

  1. Identification of the Copyrighted Work:
    A clear and comprehensive identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.

  2. Identification of the Infringing Material and Location:
    A detailed identification of the specific material that is claimed to be infringing or to be the subject of infringing activity and that is to be disabled.
    Crucially, this must include two specific URLs:
    A. The exact URL of the publicly posted video on Instagram.com (e.g., https://www.instagram.com/reel/XXXXXXXXXXX/).
    B. The specific URL on Freshsave.net where the link was processed, if known, or a statement that the link processing must be globally disabled.

  3. Contact Information:
    Sufficient information to allow the service provider (us) to contact the complaining party, such as an address, telephone number, and, ideally, an email address.

  4. Statement of Good Faith Belief:
    A statement that the complaining party has a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  5. Statement of Accuracy:
    A statement that the information in the notification is accurate, under penalty of perjury, and that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

  6. Physical or Electronic Signature:
    A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receiving a valid and complete DMCA Takedown Notice, Freshsave.net will act expeditiously to remove or disable access to the specific link processing function identified as infringing.

3. The Takedown Process and Response

Once a notice is received by the Designated Agent via email:

  1. Review and Verification:
    Our team reviews the notice for compliance with 17 U.S.C. § 512(c)(3).

  2. Expeditious Action:
    If the notice is complete and valid, we will immediately disable the ability to process the specified Instagram URL through Freshsave.net. This means the technical link extraction function will cease for that specific content.

  3. User Notification:
    We will take reasonable steps to notify the user who may have submitted the link (if such contact information is available, though typically it is not due to our anonymous policy) or the content poster on Instagram that the content has been disabled pursuant to the DMCA.

  4. No Liability:
    Because Freshsave.net does not host the content and merely acts as a technical reference tool, the site and its operators are not liable for the content itself, but rather act in good faith to promptly remove the processing capability upon notification.


4. Counter-Notification Procedure

If a user of our service (or the original content creator on Instagram) believes that the material was disabled or removed as a result of mistake or misidentification, they have the right to submit a Counter-Notification to our Designated Agent pursuant to 17 U.S.C. § 512(g)(3).

Required Elements of a Valid Counter-Notification:

A valid Counter-Notification must include all of the following:

  1. Identification of the Material:
    Identification of the material that has been removed or to which access has been disabled and the location (URL) at which the material appeared before it was removed or access was disabled.

  2. Statement Under Penalty of Perjury:
    A statement, under penalty of perjury, that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

  3. Consent to Jurisdiction:
    The subscriber’s name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or, if the subscriber’s address is outside of the United States, for any judicial district in which the service provider may be found), and that the subscriber will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.

  4. Physical or Electronic Signature:
    The subscriber’s physical or electronic signature.

Upon receipt of a valid Counter-Notification, Freshsave.net will forward a copy to the original complaining party. If the complaining party does not inform our Designated Agent that they have filed a court action seeking a court order to restrain the subscriber from engaging in the infringing activity within ten (10) to fourteen (14) business days, we may restore the link processing function to the specified URL.

5. Policy on Repeat Infringers

Although Freshsave.net does not host files, we maintain a firm policy regarding the submission of infringing material. We reserve the right, in appropriate circumstances, to terminate access to our service for any user who is determined to be a repeat submitter of links identified as infringing, regardless of whether that content is immediately removed from the internet.
